Wrongful Termination
Under normal circumstances, employers are free to terminate the employment relationship “at will”. Much in the way that employees are free to resign and seek new employment, employers too are generally free to lay off employees. However, under certain circumstances an employer’s termination of an employee will not allowed.
If an employee is terminated (or even treated unfairly) on the basis of RACE, GENDER, RELIGION, PREGNANCY, SEXUAL ORIENTATION, COLOR, CREED or DISABILITY, the employer has committed an actionable offense. Employers are also prohibited from singling out an employee for RETALIATION when the employee has engaged in certain protected actions. Protected actions may include reporting a violation, serving on a jury or generally engaging in activity that is in the public interest.
